Employee Use of Cellular Phones and Other Electronic Devices

Cellular telephones, like other District owned information resources, are provided for employees to use to conduct the business and learning support function of their positions. The following rules and regulations will give Butte School District employees guidelines for cellular telephone use.

1.    PURPOSE

District cellular telephones and connection services are provided for employees who need to be mobile, yet stay in communication with each other and/or outside agencies and individuals on a regular basis. District cellular telephones facilitate employees in a variety of positions with increased communication capabilities throughout their workday. Some positions may require the use of a District cellular telephone on a regular daily basis.

2.    PERSONAL RESPONSIBILITY

I understand that I am a representative of Butte School District #1. I accept personal responsibility for using the District cellular telephone and service in an ethical and responsible manner. I also understand I am responsible for reporting any misuse of District cellular telephones to my immediate supervisor. Misuse can come in many forms, but is commonly viewed as any message(s) or information that is sent that constitutes pornography; unethical or illegal solicitation; ethnic, religious, racial or sexual harassment; inappropriate language; and other issues, some of which are described below. All the rules of conduct described in this document apply at all times when I am using District cellular telephones.

3.    USES THAT REQUIRE DISTRICT REIMBURSEMENT

I agree to pay for any extra costs related to this phone such as ring tones, downloads, music, data usage, unauthorized use and picture messages that incur a cost beyond the regular contracted services.

4.    UNACCEPTABLE USE

a.    Transmitting any message(s) or information in violation of federal, state or local laws or regulations is prohibited.
b.    Transmitting any message(s) or information for personal, financial or commercial gain is prohibited.
c.    Transmitting any message(s) or information that is threatening, obscene, disruptive, sexually explicit, protected by trade secret, or that could be construed as harassment or disparagement of others based on their race, national origin, sex, sexual orientation, age, disability, religion, or political beliefs is prohibited.
d.    Transmitting any message(s) or information that would place the school, department or District in an embarrassing position is prohibited.
e.    Using a District cellular telephone in an illegal or unsafe manner.
f.    Use of cell phones by non-authorized personnel is prohibited.

5.    PRIVILEGE

I understand that the use of a District cellular telephone is a privilege, not a right, and inappropriate use of my telephone may result in a restriction or cancellation of my privileges. I agree to all of the following and must sign an acknowledgement before I will receive a District cellular telephone.

a.    To annually plan with my school, department or program, for the budget to cover the cost of all cellular telephone hardware, supplies, batteries and connection charges.
b.    To follow all city, county or state ordinances that govern the use of cellular telephones.
c.    To be responsible for the payment of any fine or legal fees resulting from a citation received for illegal or unsafe use of a District cellular telephone.
d.    To be responsible for any accidents or injuries to others that result from the illegal or unsafe use of a District cellular telephone.
e.    To care for the cellular telephone to keep it in good working order.
f.    To reimburse the appropriate District account for the replacement cost of the cellular telephone if it is damaged (beyond normal wear and tear) or lost. The reimbursement requirement for stolen cellular telephones will be reviewed on a case-by-case basis.
g.    To store the cellular telephone in a safe, locked location during any months that I am not on duty, or at other times when it is not in my personal possession.
h.    To surrender the cellular telephone to my immediate supervisor upon separation from the District, or if I am transferred to another site, department or program. It will be the responsibility of the immediate supervisor to cancel service if the cellular telephone is not going to be reassigned to other personnel.
i.    To understand that cellular telephone bills are public information and they may be reviewed by the immediate supervisor and/or Technology Department personnel for acceptable use practices.
