Butte School District

THE BOARD OF TRUSTEES

2161

Special Education

The District shall provide a free appropriate public education (FAPE) and necessary related services to all children with disabilities residing within the District, as required under the Individuals with Disabilities Education Act (hereinafter “IDEA”) and implementing provisions in Montana law, and the Americans with Disabilities Act. The District will continue to provide FAPE to students with disabilities until their 22nd birthday or until their exit from eligibility for special education services by earning a regular high school diploma based on the District's graduation requirements and that was not based on a lesser credential, whichever occurs sooner.

For students eligible for services under IDEA, the District shall follow procedures for identification, evaluation, placement, and delivery of service to children with disabilities as provided in the current “Montana State Plan Under Part B of the Individuals with Disabilities Education Act.”

The District may maintain a membership in one or more cooperative associations, which shall assist the District in fulfilling its obligations to the District’s disabled students.
